In her August 2016 column for The Legal Intelligencer, Andrea M. Kirshenbaum looks at recent litigation against restaurants that challenges application of the tip credit to servers who are performing non-tipped duties and the use of tip pooling for employees not eligible for the tip credit.
She notes:
"Given the continued litigation challenging tip pooling arrangements as well as the recent developments in the tip credit arena, employers utilizing the tip credit or tip pooling should assess current practices and consider modifications to those practices to address this ongoing area of legal exposure."
