Employment Chair Sid Steinberg Examines a Case Involving an Employee's Claim of Discrimination in the July 8 issue of The Legal Intelligencer

Sid SteinbergEmployment & Employee Relations Chair Sidney R. Steinberg looks at the case Nunn v. NHA Human Services in his July 2015 Employment Law column for The Legal Intelligencer. The case involves an employee's discrimination claim involving an employer's failure to promote her in selecting another candidate for a director-level position. 

In looking at the facts of the case, Mr. Steinberg notes that: 

"Discrimination claims based upon an employer’s failure to promote or hire remain among the more difficult claims for employees...employees seeking to demonstrate discriminatory animus must demonstrate both comparable qualifications to the selected candidate and pretext in the decision-making process."
