Employment Principal Andrea Kirshenbaum and Associate Darren Creasy Examine the Benefits of Wage and Hour Audits in April 7 issue of The Legal Intelligencer

Employment & Employee Relations Principal Andrea M. Kirshenbaum and Associate Darren M. Creasy collaborated on an article for The Legal Intelligencer on April 7. The article looks at how employers can help mitigate against future litigation issues by proactively pursuing wage and hour audits within their organizations. 

Ms. Kirshenbaum and Mr. Creasy write that, "Rather than adopt a passive approach, many [employers] have elected to audit wage-and-hour practices proactively to measure compliance with existing laws and take affirmative steps, where appropriate, to better position their organizations for the inevitable. Far better to learn of potential compliance issues by way of an audit rather than a lawsuit, right?" 

They go on to examine the one or more areas a wage and hour audit may encompass, including: 

  • Analysis of worker classifications
  • Assessment of potential exposure for off-the-clock work
  • Review of pay practices
  • Privilege considerations and methodology
