Mason Avrigian, Jr. and Jeff Wallack Explore the Impact of the Trump Administration's Steel Tariffs on the Construction Industry for The Legal Intelligencer


In The Legal Intelligencer's August 2018 Construction Law Supplement, Construction Principals Mason Avrigian, Jr. and Jeffrey P. Wallack examined the impact of the Trump Administration's steel and aluminum tariffs on the construction industry. The article, "The 2018 Steel and Aluminum Tariffs— Do Contractors Have Remedies?" examines whether a contractor adversely impacted by the tariffs has any available remedies to recover additional costs incurred or to be incurred to procure steel materials and perform the work. 

They note in the article:

"The [steel and aluminum] tariffs present challenges to contractors who seek to offset or recover the price increases. Contract clauses may provide a source for relief, but unless the contract contains a specific clause allowing the contractor to recover for steel price fluctuations, an effort should be made to negotiate a resolution and thereby mitigate the contractor’s risk, cost and exposure."
