Paul McIntyre and Steve Luttrell Examine Legionnaires' Disease and Related Concerns in Commercial Real Estate Deals for The Legal Intelligencer's 2016 Environmental Law Supplement

In the 2016 Environmental Law Supplement published by The Legal Intelligencer, Environmental Practice Group Co-Chair Paul R. McIntyre and Associate Stephen E. Luttrell examine recent and well-publicized outbreaks of Legionnaires' disease over the last year. They also explain why prospective purchasers of buildings, particularly those in the health care and hospitality industries, should ­consider incorporating Legionella assessments into their pre-acquisition due diligence protocols.

They note in the article: 

"Legionella within building water systems represents an often overlooked source of potentially significant risk and liability. Given the increase in Legionellosis outbreaks and related personal injury lawsuits, the recent issuance of new industry standards, and the adoption of related regulations, building owners and operators would be wise to evaluate their water systems and implement the new ASHRAE standard [that] provides the basic components of a Legionella prevention plan, and...is not terribly burdensome or expensive to implement."
